New rules on consumer protection in the retail electricity market

On 8 May 2025, the Government (Social Democratic Party, Venstre and Moderates), the Danish Democrats, the Socialist People's Party, the Conservative People's Party, the Unity List, the Danish People's Party, the Radikale Venstre and the Alternative have published a voting agreement on “Consumer protection in the retail electricity market”.

The main points of the agreement are (freely translated) as follows:

1. Build more trust in retail electricity companies and punish those who break the rules

a. Quarantine in Datahub in case of violation of rules (e.g. misleading marketing) that will eliminate the possibility of enlisting new electricity customers during the quarantine period

b. Higher fines for infringements, including the possibility of day fines

c. Requirement for a deposit of 1 million. DKK to Energinet for access to Datahub for new retail electricity companies

d. A limit of max. 3 months for aconto invoicing

e. Telephone conversations related to the sale of electricity contracts must be recorded  (no recording = invalid agreement).

f. Requirement for MitID or similar written documentation for the conclusion of an electricity contract by the customer

g. Better overview of concluded agreements through mandatory contract summary that must follow standard template from the Danish Energy Agency

2. Creating a more transparent electricity market

a. Requirements are introduced for the websites of electricity retailers, including the disclosure of consumption-dependent (e.g. spot price surcharges) and independent costs (e.g. a subscription fee), as well as uniform language usage

b. Consumers shall have the opportunity to view their own consumption and prices and tariffs at the time of consumption.

c. Elpris.dk is updated to prevent manipulation and make the site easier to use.

 

These new requirements are expected to be passed into law with effect from January 1, 2026, however, the deposit provision will take effect from May 8, 2025.
